Terrorist Dzhokhar Tsarnaev's death sentence may be overturned due to bureaucratic delays

In 2015, Dzhokhar Tsarnaev was sentenced to of death for the 2013 Boston Marathon bombing. But in 2020, the court overturned the verdict because it turned out that the jury was not impartial and was subject to pre-trial publicity. Sentence in March 2022 restored, and on March 21, 2024, the US appeals court returned the case of the Boston terrorist to a lower court. This could lead to a review of the death penalty, reports Reuters.

Tsarnaev's lawyers insist two jurors were biased during their sentencing. If the judge confirms this, the death sentence will be overturned and the trial will begin again.

“We are remanding this case to the district court to determine whether any of the jurors should have been discharged on grounds of bias,” the court said. “We emphasize again: the only question in any such proceeding will be whether Tsarnaev faces execution.” Regardless of the outcome, he will spend the rest of his life in prison."

Two jurors lied about not discussing details on social media before participate at the hearing of the case.

The US Supreme Court did not take this argument into account when it reinstated Tsarnaev's death sentence in 2023. The district judge argued that the high-profile case received widespread news coverage that showed "chilling" photos and videos of Tsarnaev and those injured and killed in the attack. Thus, the trial judge included in the number jury those who "has already formed an opinion about guilt Dzhokhar."

Why was the sentence overturned?

Lawyers for Tsarnaev, 30, said a friend of one of the jurors told him on Facebook to “join the jury” and send Tsarnaev “to jail where he will be taken care of.”

Tsarnaev is currently serving his sentence in the American maximum security prison ADX Florence in Colorado, known as the “Alcatraz of the mountains.”

Dzhokhar Tsarnaev participated in the preparation and execution of the 2013 Boston Marathon bombing. As a result, on April 15, two explosions occurred, killing three people, including one child; another 282 people were injured, many of them losing limbs. One policeman was killed during a shootout with law enforcement officers.

The explosive devices were made from steel pressure cookers filled with nails and ball bearings. The investigation established that the organizers of the terrorist act were the Tsarnaev brothers - Tamerlane and Dzhokhar. Tamerlan Tsarnaev was killed in a shootout with the police.

The Tsarnaev brothers, half Chechen and half Dagestani, moved to the United States from Dagestan in 2002. Tsarnaev Sr. tried to become a professional boxer in the United States; he was prone to religious extremism.

Explosion victims There has been disagreement for years over whether Tsarnaev should be executed.

"My position is he should be dead by now," said Mark Fucarile, who lost his right leg in the second explosion. He said further litigation would be a waste of time and money.

Mikey Beauregard, who lost his hearing and suffered a traumatic brain injury as a result of the attack, agreed with the decision. He said further investigation was needed "to ensure fair justice and compliance with the Constitution and the law."
