Many EU countries cancel Schengen visas for Russians right at the border

Recently, information has appeared that Russians are canceled Schengen visas immediately at the entrance to the Schengen zone, even if the visa was issued by another country. Edition Meduza told how often this happens and what to expect next.

Who has had their visas cancelled?

Ksenia Sobchak reported that Estonian border guards canceled a Russian woman's French visa due to suspicions of currency smuggling. She also said that another Russian woman was "overboard" - her Greek visa was canceled when she tried to enter Estonia, and the reason was not explained.

Russian journalist Yaroslav Varenik was also not allowed into Estonia. His visa was canceled due to the fact that the purpose of his stay was not justified.

And two more journalists lost their Schengen visas due to propaganda when they decided to prepare several materials for their publication during their vacation. Ksenia Soldatova and cameraman Dmitry Timofeev work for Izvestia.

Different media also talk about such cases - not only Estonia does this: several Russians had their Finnish visas canceled already at the border with Finland.

What's going on

So far, such cancellations are single, mass complaints have been received. And most often this happens with those who provide false information.

And at what it is a fairly normal practice of entering the Schengen zone.

Vitaliy Slepak, Senior Associate at the Pen & Paper Bar Association, Ph.D. in Law, said that there are many cases when previously issued visas were canceled after the embassy or consulate made a repeated request to the hotel indicated in the questionnaire and found out about the cancellation of the reservation. The tourists themselves often found out about such annulment only at the border.

At the same time, it is worth noting that not only the competent authorities of the Member State that issued it, but also the competent authorities of another Schengen Member State can cancel a visa. Therefore, getting a visa and hoping to slip across the border with another country will not work. In the second case, these authorities only have to report the annulment of the visa to colleagues from the state that issued it.

Grounds for canceling a visa

Important: there is a difference between cancellation and cancellation of a visa. Both of these procedures lead to the same result (the visa ceases to be valid), but the reasons for them are different:

• a visa can be canceled if the necessary conditions were not met at the time of its issuance (for example, if the visa was obtained fraudulently);
• a visa can be canceled if it is found that the conditions for issuing have ceased to be fulfilled (say, the applicant committed an administrative offense and was blacklisted by the Schengen system).

You may not be allowed in if you did not provide one or more of the required documents upon entry. The visa will not be canceled or canceled, but you may be deprived of the right to cross the border.

That is, entry will be banned without canceling the visa.

No entry

And although the ban on entry into the territory of the states that are part of the Schengen area is provided for by EU law, it is not based on citizenship, that is, Russian citizenship in itself cannot be a basis.

Doctor of Law Professor Paul Kalinichenko said that the Schengen Code has a list of grounds for non-admission. It includes but is not limited to:

• expired passport;
• provision of false documents;
• staying 90 days in Schengen within a six-month period;
• a threat to public order and international security.

At the same time, refusal of entry does not mean that the visa is invalid. For example, if you were not allowed into the Schengen area because you did not provide proof of sufficient funds, then at another border crossing point you can show the presence of these funds and enter the EU.

In addition, even the annulment or cancellation of a visa can be challenged. You should file a complaint with the authorities of the country that issued the annulment decision, and after that you will be scouted what to do next, since each country has its own rules.

Will there be mass cancellations

So far, there are no signs that the Russians will begin to massively cancel Schengen visas. Each case is considered separately.

Before the trip, be sure to check the validity of the visa, take with you all the necessary documents that determine the purpose, route and duration of the trip, as well as the required amount of money.

But some experts note that the visa issue today is more political, so you should expect anything.
