USCIS has changed the process of issuing visas for talented people.
The United States Citizenship and Immigration Services (USCIS) began accepting copies of negative union advisory letters from 14 September regarding current or future applications for a non-immigrant O-type visa.
O-1 and O-2 nonimmigrant visas are available for people with extraordinary abilities to science, business, athletics or the arts, as well as individuals with exceptional achievements in the film or television industry. An advisory letter from the American labor organization or trade union is usually required to apply for an O-type visa.
As a rule, the applicant provides a consultation letter with the petition, and this requirement of the process remains unchanged, despite the fact that now copies of the negative letters will be sent to USCIS.
Union representatives had previously complained that some advisory opinions could be falsified by applicants and presented to the USCIS as not negative, but positive opinions. In order to avoid such fraud, unions will now be able to send a copy of a negative advisory letter to USCIS so that it can be compared with the letter the applicant will provide.
Trade unions must send copies of letters to: [email protected]. In order for USCIS to accurately match O visa application letters, labor organizations must include the last five digits of the applicant's passport number in copies of the letters. Only copies of consultation letters with negative findings will be sent to USCIS; positive letters will not be sent to the agency.
After six months, USCIS will analyze the data collected to determine how to improve the process of receiving advisory letters from trade unions.
