Three children and a 22-year-old nanny sat at a table in the courtyard of the Bistro 65 and had breakfast. The waiter placed a hot coffee pot on the table within reach of little Hadley, who was sitting on a wooden high chair.

Hadley pulled the pot down and spilled the scorching liquid on her torso, hips and fingers of her left hand. No adult saw the incident: the father was fiddling with the stroller, the mother was in the bathroom. Both heard their daughter screaming.
Hadley's older brother, who is now 8 years old, testified at the trial and demonstrated how the waiter set the coffee pot in front of his little sister. As a result, the child received third-degree burns, requiring several operations. The girl will remain injured for life. When she grows up, she will need additional surgery.
The resort's attorneys argued that the girl did not pull the coffee pot, but rather reached for a cup filled with coffee. According to them, the waiter put the coffee pot on the table on the instructions of the nanny. At trial, the waiter confirmed that he warned the nanny that the coffee pot was “hot.” The hotel also blamed the nanny for not properly supervising the children and the parents for the nanny being responsible for three small children.
A jury acknowledged that the resort has been negligent, and has now awarded three-year Hadley 5,6 million dollars in compensation, including 160 970 dollars to cover past medical expenses, 441 397 dollars to cover future expenses and 5 million dollars to cover non-economic losses . The jury also awarded the family of the girl a total of 879 000 dollars in compensation for emotional damage.
The court found that the resort was 92,5% responsible for the incident and the nanny was 7,5% responsible.
