Fraudsters in New York are trying to use the attempts of illegal immigrants to obtain legal legal status, falsely promising them a US visa, which allegedly can be obtained after 10 years of living in the United States in any status.
About this warns the Department of Consumer Affairs of New York (DCA), writes Gothamist.
Unscrupulous immigration services and lawyers advertise the “easy" opportunity for immigrants to get legal status if they have lived in the US for more than 10 years.
According to the advertisement, illegal status can be corrected very easily and quickly, although, in fact, the procedure requires prior deportation of the illegal, after which it is necessary to prove his “extraordinary and exceptional circumstances”, because of which he needs a visa or a green card. After that, his application will be considered, but this process may take several years and does not guarantee a positive result.
According to DCA, at least one immigrant spent 25 000 dollars on the proposed “easy” visa, without having obtained the desired result.
Scammers promise their clients to organize a procedure for them Cancellation of Removalwhich is available to some illegal immigrants with unique circumstances after 10 years of living in the USA. However, the application of this procedure by the immigration court takes place on an exclusively individual basis and is not an automatic way for an illegal immigrant to obtain a visa or a green card. To apply this procedure, it is necessary to prove that a close relative of an immigrant who is a US citizen will face serious difficulties in the event of deportation of an immigrant, in addition to illegal, to cancel the deportation it is necessary to provide evidence that he is a person of high moral character without a serious criminal history.
DCA recommends that residents of New York, regardless of their immigration status, use free and secure legal services for immigrants provided by the city authorities.
