US Citizenship and Immigration Services (USCIS) announced the expansion of the existing program (the so-called Provisional Waiver Process), which allows relatives of US citizens and green card holders who have exceeded their legal stay in the country, but at the same time have the right to receive a migration visa, to unite with their family in USA.

If earlier, only close relatives of US citizens and permanent residents could apply and level up the fact of illegal stay in the country, then from the end of August other citizens will also be eligible. criteria to submit such an application if they can prove that their relatives left without them in the United States will find themselves in an “extremely difficult situation.” Citizenship and Immigration Services promises to provide a detailed description of situations that fall into this category.

The program allows you to reduce the waiting time for family reunification - those who did not fall under it had to first undergo an interview in their home country to receive a green card and only after the US State Department determined that they were prohibited from entering the US territory due to... for illegal stay, submit a request to remove such status. Now, program participants will be able to submit the appropriate application in the United States before leaving home for an interview.

Applicants to the program must meet a number of requirements. In particular, they must be in the United States and be the beneficiary of an approved petition for permanent residence, which is filed by a US citizen or a green card holder for a foreign relative.

The Citizenship and Immigration Service expects that an expanded program will reach far more people than it is now.

The new rule amends the I-601A form. The updated profile will be available on the USCIS website at the link. uscis.gov/i-601a from 29 August.

The message notes that applications under the new rules can only be submitted from August 29. If you apply early, you will receive a refusal.
