In Russia, the court allowed the sale of “sanctioned” products
The Arbitration Court of St. Petersburg and the Leningrad Region did not find any violations in the sale of products in Russia, the import of which is prohibited under the food embargo.
The court considered the complaint of the Magnit retail chain against a fine imposed by Rospotrebnadzor in the Leningrad Region.
“The government has provided restrictions on the import of certain products, and not their implementation (sale). It follows from this that the restriction on the turnover (sale) of dairy products, including cheeses, is not enshrined in law, that is, there is no corpus delicti,” the court decision says.
Thus, the court decided that a ban on the import of “sanctioned” products is not equivalent to a ban on their sale.
Previously, the Magnit chain was fined 30 thousand rubles by Rospotrebnadzor for the illegal sale of cheese prohibited for import into Russia.
In late June, the Russian authorities extended food embargoes from countries that have imposed sanctions against Russia in connection with the situation in Ukraine and the annexation of the Crimea.
Before that, the European Union extended the validity period economic sanctions against Russia for half a year.
