USCIS has exhausted the limit on H-2B work visa applications for the first half of 2019

The US Citizenship and Immigration Services (USCIS) 12 December announced that the number of H-2B work visas submitted for the first half of the fiscal year 2019 exceeded the rate set by the US Congress.

December 6 has expired application deadline for anyone who intends to start work in the US before April 1 2019 of the year, the report says department press services.

USCIS will reject all new H-2B visa applications received after December 6, which are requesting a start date in the US before April 1 2019.

As of December 6, the number of H-2B visas received by USCIS exceeded the total H-2B visa limit available for issuance in the first half of the 2019 fiscal year. In accordance with the rules, USCIS uses a computerized random selection process (lottery) to ensure a fair selection of those whose applications for work visas for the first half of the financial year 2019 will continue to be processed. 11 December 2018 of the year USCIS conducted the lottery and began processing selected applications.

USCIS will continue to accept applications for work visas such as H-2B from certain groups of migrants, in particular:

• immigrants working in the United States at the moment and applying for the extension of their work visa, including if it provides for a change in the terms of the contract or employer;
• people involved in the production of caviar;
• workers engaged in the provision of services or other activities in the Commonwealth of the Northern Mariana Islands or Guam from November 28 2009 to December 31 2019.

H-2B visas are issued to qualified and unqualified citizens of foreign countries who come to the United States for temporary work.

Currently, Congress has set the H-2B visa limit on 66 000 for one fiscal year: 33 000 - for employees who start work in the first half of the fiscal year (from October 1 to March 31) and 33 000 for employees who Begin operations in the second half of the fiscal year (from April 1 to September 30).
