Asylum seekers now need to come to their USCIS interview with their own interpreter

From 13 September 2023, asylum seekers must invite an interpreter to their interview if they do not speak English or wish to speak another language, reminds US Citizenship and Immigration Services (USCIS).

If an applicant needs an interpreter but shows up without one, or if the interpreter does not speak English and the language the applicant speaks, USCIS may consider this a failure to appear for an interview and deny the asylum application or refer it to an immigration judge.

In each case, the service will determine whether the asylum seeker came to the interview without an interpreter for a valid reason or not.

The interpreter must be fluent in English and a language that the applicant speaks fluently and must be at least 18 years of age.

A translator cannot be:

• The applicant's lawyer or his accredited representative;
• A witness testifying on behalf of the applicant;
• A government representative or employee of the applicant's country of nationality (or, if you are stateless, your country of last residence); or
• A person who has a pending asylum application and has not yet been interviewed.
