This measure requires the participation of at least one female director in each board of Californian corporations by the end of next year, notes New York Post. By the end of 2021, companies will need up to three female directors, depending on the number of empty seats on the boards.

“I do not minimize possible shortcomings that could prove fatal to its eventual implementation,” Brown wrote in a statement announcing the law’s signing. “However, recent events in Washington and beyond make it abundantly clear that many are not getting what they are trying to communicate.”

Some European countries, including Norway and France, have already declared that women should be included in the composition of corporate councils. State Senator Hanna-Beth Jackson, one of the authors of the SB 826 bill, is convinced that if there are more women on the boards, then the companies will be more successful.

A Santa Barbara Democrat said women interact more effectively and work better in multitasking. She believes that more women in power can also help reduce harassment and harassment in the workplace.

A quarter of California open-head companies do not include women on the board of directors at all. These companies have not done enough to increase the number of women on the boards, despite the call of the legislature, which makes government intervention necessary, Jackson said.

“This is one of the last bastions of general male dominance,” she added. “We know that the public and businesses are not satisfied with this level of discrimination.”

The California Chamber of Commerce argued that the composition of corporate councils should be determined within the company, and not by outside government intervention. The Chamber said the new law would prioritize gender issues in other aspects of diversity, such as race and ethnicity.

“This poses a challenge for the council to achieve broader diversity goals,” said Jennifer Barrera, senior vice president for policy at the chamber. She said the new policy is difficult to implement and violates constitutional prohibitions on discrimination.

The law applies to companies that officially have top executive offices in California. Companies can be fined 100 thousand US dollars for the first violation and 300 thousand for the subsequent ones. The law also requires companies to report on the composition of the board of directors to the state secretary and imposes a fine of 100 thousand dollars for the absence of such a report.
