US authorities intend to legitimize the existence of only two sexes

The Trump administration considers the term “gender” to be a biological, immutable state defined by the genitals at birth. This is the most decisive step in the framework of government efforts to roll back the recognition and protection of transgender people, in accordance with the federal law on civil rights.

A number of decisions by the Obama administration have weakened the legal concept of a gender perspective in federal programs, including in the field of education and health, recognizing a gender issue as a person’s choice, not determined by gender, assigned at birth. This policy has led to discussions around the use of latrines, dormitories and other places where gender identification has played a major role.

Conservatives, especially evangelicals, were outraged.

Currently, the Department of Health and Human Services is leading the work to establish a legal definition of sex in accordance with Section IX, a federal law on civil rights, which prohibits discrimination on the basis of sex in educational programs that receive state financial assistance, according to a memorandum received by The New York Times.

In its memo, the department argued that key government agencies need to adopt a clear and uniform definition of gender, which is determined "on a biological basis" - male or female genitalia.

“Sex refers to a person’s status as male or female based on immutable biological characteristics that can be identified before or after birth,” the department proposed in a memo that was developed and distributed since last spring. "The sex listed on a person's birth certificate, as originally published, constitutes conclusive evidence of a person's sex unless rebutted by credible genetic evidence."

The new definition would essentially eradicate federal recognition of the estimated 1,4 million Americans who have chosen to identify themselves—surgically or otherwise—as a gender other than the one they were born into.

This move would be the most significant of a series of maneuvers to cancel the more active recognition of the Obama administration's gender identity. Trump administration tried to ban transgender people to serve in the military and legally contested the protection of civil rights for a group included in the country's health care law.

Several departments recalled the policy of the Obama era, which recognized gender identity in schools, prisons and shelters for the homeless. The administration even tried to remove gender identity questions from the 2020 census survey of the year and the national survey of senior citizens.

Last year, the Department of Health and Human Services stated privately that the term “gender” should never include gender identity or even homosexuality. The lack of clarity allowed the Obama administration to illegally extend the protection of civilians who should not have them.
