New York became the fifth after California, as well as the states of Oregon, Washington and New Jersey, where they were allowed to indicate such a floor. Transgender activists have long insisted on simplifying the procedure for changing identity documents.

They called strict separation between men and women a form of discrimination.

In 2014, New York State law allowed transgender people to change gender on birth certificates, but the US government required a doctor's confirmation of a gender change. In September 2018, the District Court in Denver ruled that the State Department could not refuse an intersexual gender-neutral passport. Now you can choose the third floor with personal written evidence, and confirmation from the doctor is not required.

The question of not recognizing the third sex by another state remains open - there is no judicial practice on this issue yet.

In August of this year, the German government officially approved the registration of the third floor in the registry office. Before that, the Constitutional Court of Austria allowed citizens to indicate a third gender in their passport.
