The 9 US Circuit Court of Appeals postponed the entry into force of the order until it considers an emergency petition from the government that appeals the ban on San Francisco judge Richard Seeborg. The judge took out his 8 April.

The appeal decision was made by a panel of three judges, which includes two appointed by the Democratic presidents, and one judge appointed by the Republican.
