In California, the mother was deprived of parental rights, although she took care of her daughter
The court can deny parents custody even when they do everything possible to control their children, and children are not lawbreakers.
This decision was unanimously adopted by the Supreme Court of California, writes SF Gate.
The decree was made within the framework of a law that would deprive parents of guardianship if they put children at risk of physical or mental injury, or in the event of the inability of parents to properly control or protect them. This law is often applied in cases where the parent neglects the child, as well as in the event that the parent becomes homeless or mentally disabled.
However, the decision of the California Supreme Court did not concern any of these conditions. A Los Angeles-based mother tried in every way to control and protect her teenage daughter, looking for her every time she left home, sending her to live with her grandparents, and also calling the police and employees of the district's family affairs department Los Angeles when she needed help.
At the same time, her daughter repeatedly ran away from home, gave birth to a child at the age of 15, and missed school.
In 2014, the court decided to transfer the 17-year-old girl to the jurisdiction of juvenile justice, and the child was placed in a special institution. An attempt by the mother to discipline the child through the court reached the state Supreme Court.
This body 20 July recognized the girl incorrigible, and agreed with the statement of her mother that she did everything she could to control the child, and accordingly the mother was not guilty of her behavior.
But at the same time, the court noted that for the deprivation of parental rights, legislation does not require the establishment of the mother’s guilt, but only the determination that she cannot save the child from hurting herself.
