A Los Angeles County court on January 27 sentenced Hannah Tubbs, a transgender woman from California, to two years in a juvenile detention facility after she pleaded guilty to molesting a 10-year-old girl in 2014, reports FoxNews.

Tubbs, 26, recently pleaded guilty to molesting a girl in a women's bathroom eight years ago, two weeks before her 2th birthday. “Tubbs is 26 years old. Unlike George Gascon's misjudgment, she's not a "child," said Los Angeles Deputy District Attorney John Khatami, who is assigned to the Child Abuse Unit.

“During the juvenile proceedings, evidence was presented that showed Tubbs had sexually abused two children in separate incidents in the past. Child victims will suffer from trauma for the rest of their lives. Tubbs also had previous convictions for violence and acted like an adult,” he added.

Prosecutors say that in 2014 year Tubbs forwent to the women's toilet, grabbed the girl by the throat, locked herself in the booth with her and put her hand in her panties. Another person who entered the toilet was able to stop further actions.

Because Tubbs began to identify as a woman after she was taken into custody and Gascon refused to try her as an adult. Tubbs was sentenced to two years in a juvenile detention center. According to Deputy District Attorney Shi Sanna, the maximum sentence in the new program for anyone over the age of 25 is two years.

The verdict drew criticism from Gascon, who promised to "immediately stop the persecution of children as adults." Gascon has cited studies showing that brain development is not complete until a person is 25 years old and argues that the detention of offenders as juveniles can rehabilitate young offenders.

The Los Angeles County Sheriff's Office offered to place Tubbs in the county jail, but Judge Mario Barrera ultimately "determined that he did not have the authority to issue an order for Tubbs to be placed in the county jail," Sanna said, adding that the judge "had hands." connected".

Barrera reportedly blamed Gascon's politics for not taking Tubbs to adult court during the January 27 trial.

"I want to be clear," Barrera said during sentencing on Jan. 27 in a Lancaster, California courtroom.

“Barrera’s hands were tied,” Sanna said. Ultimately, the judge “decided that he did not have the authority to order Tubbs committed to the county jail.”

Katherine Barger, chairman of the Los Angeles County Board of Supervisors, called the outcome of the case "unsatisfactory" in a January 27 statement.

“Judge Barrera's hands were tied today because the DA's office failed to file a motion to transfer Tubbs to the adult criminal court where the case should have been tried,” Barger said. “Instead, we are left with a 26-year-old man sentenced to two years in a juvenile detention facility, isolated from other juveniles.”

In a January 18 letter to Barger, Gascon called Tubbs' behavior "deplorable".

“I am shocked and outraged that she has evaded arrest for so long. The harm she has caused is irreparable,” Gascón wrote.

Tubbs was not linked to the case until 2019. Her DNA was entered into the database the same year after her arrest on suspicion of battery in Idaho. Prosecutors charged her in a 2014 assault case in 2020, shortly after Gascon took office.

Tubbs had previously been arrested for battery, drug possession and probation violations in Idaho and Washington. She has a pending misdemeanor case in Washington and was also charged with sexually abusing a minor in Kern County, California, but the case has not been brought to court. It is reported that Tubbs can also be classified as "developmentally disabled" and have several mental illnesses.

Gascon said he was concerned that Tubbs might be victimized in an adult facility as a trans woman, and said that the probation report recommended that she be sentenced to home confinement.

“Because of George Gascon's strange policy against bringing any juvenile to adult court, even if a 17-year-old rapes or kills an innocent child, James Tubbs will not have to register as a sex offender, he will not spend any time in the county jail or in a state prison, he is 26 years old and will be placed with minors for a very short period of time, and will be released without probation or parole.
