The United States insists that countries repatriate their citizens who joined the terrorist group in Iraq and Syria and attend to their legal prosecution. But the United States refused a request for the return of 24-year Mutane Movewho was born in New Jersey in the family of a Yemeni diplomat.

The father of the woman, Ahmed Mutana, filed a lawsuit against the administration of President Donald Trump and Secretary of State Mike Pompeo, saying that his daughter is a citizen of the country.

The difficult issue remains the status of Ahmed at the time of the birth of Mutana's Turns in 1994. Then he served as a diplomat and was in the United States on a diplomatic visa. According to the United States Citizenship and Immigration Services, children of foreign diplomats do not receive citizenship by birth, as they are not under the “jurisdiction” of the United States, as required by the 14-I amendment.

On February 20, Donald Trump tweeted that he had "instructed Secretary of State Mike Pompeo - and he fully agrees - to keep Hoda Muthana out of the country!"

A lawsuit filed on the same day noted that prior to Pompeo and Trump’s statements, “The United States did not take any legal action to revoke Mutana’s citizenship.”

And although Pompeo called her a terrorist, the United States did not formally accuse Mutan of committing any crime, including treason, and did not intend to deprive her of her citizenship. Instead, the presidential administration claims that Mutana was never a citizen of the United States.

Lawyers do not dispute the period of the woman's life spent in ISIS. They say Hoda Muthana "wants to face the US justice system and pay off his debts to society," as quoted by lawyer Hassan Shible.

Khoda informed her father and lawyer of her desire to return, despite the fact that she had been warned about the possibility of criminal prosecution and subsequent conviction in her homeland.

Lawyers say that the administration is not right regarding its citizenship, because at the time of the birth of Hoda, her father no longer served as a diplomat. Human rights activists released a letter to the United States mission to the United Nations, which states that Ahmad Mutan was dismissed from his post as a diplomat on September 1 of the year 1994. Hoda was born almost two months later, on October 28, therefore, according to lawyers, she had the right to citizenship by birthright.

Charlie Swift's lawyer also said that the State Department confirmed the citizenship of Hody by giving her a US passport - this happened in 2005 a year, a year after her citizenship was already questioned and her father handed the letter to the agency. In 2014, Mutana renewed her passport and never officially renounced her citizenship.

The State Department confirmed that Pass had been issued a passport, but it was recalled after she joined ISIS in 2014. A State Department spokesman told ABC News: “There are many reasons why a person who has previously received a passport may later be found to be inconsistent with that passport. If it is determined that the bearer has no right to the issued document, the passport can be canceled and / or the application for renewal is rejected. ”

While Muthana's lawyers and family say her father was no longer working as a diplomat, much depends on his immigration status at the time of her birth. "If he had applied for a green card and was no longer entitled to diplomatic immunity, his daughter would have become a citizen," said Steve Vladeck, a professor at the University of Texas School of Law.

The issue will now have to be decided by a court: "Neither the Secretary of State nor even the President of the United States has the authority to determine a person's citizenship," Vladeck told reporters.

Mudana’s turn implores her to return to the United States for her 18-month-old son, fearing “to lose him for decades.”

Speaking about the dangers of life in a military zone in Syria, she wrote: “I want him to always be with me, I want to protect him. I can not call myself a good mother and regret it. But he was born here, I could not help it. ”
