California resident sued Delta because of harassment of fellow traveler

23-year-old resident of California filed a lawsuit against Delta Airlines for 6 million dollars, saying that the airline's employees refused to detain a passenger who molested her during the flight in June.

Delaney Lou, the founder of fashion brand I Am Plenty, claims that a drunken passenger explicitly molested her on June 16 on a flight from Chicago to Los Angeles, writes Fox News. In a lawsuit filed by lawyer James Friauff of Knoxville, Lou claims that the man took six to eight alcoholic beverages within a few hours.

In the statement, Lou claims the attacker became increasingly "strange and frightening" throughout the flight, attempting to engage her in conversation about his marriage. At one point, he pretended to call a non-existent "Molly" to discuss how Lou wasn't "nice" to him, and then made derogatory remarks about Lou to an imaginary friend.

Lu claims she tried to make a "non-obvious" hint about the situation to the flight attendant by giving her a "concerned look." According to the woman, she eventually managed to fall asleep, but woke up a short time later, feeling frightened “discomfort in the vaginal area” and allegedly finding a man’s hand in her trousers.

Lu's lawsuit alleges that she then stood up and walked in front of the man, who was sitting in the aisle and tried to draw her attention to his visible erection, and then ran to the back of the plane to report the matter to the flight attendants. The woman was moved to another place. She assumed that the airline would contact the authorities in response to her complaint. Instead, Lu said, the airline "allowed the attacker to get off the plane without consequences for his heinous actions."

Speaking about the incident in a series of tweets in July (now deleted), Lu wrote that the Delta team promised to "handle the situation" after landing. This was not done, according to the victim. She complained about this fact and received a $200 voucher as compensation.

Delta then released a statement to Fox News saying Lu told a Delta agent about the incident "after disembarkation."

“The safety and security of our customers is our top priority and we do not tolerate harassment or assault by passengers. After disembarking, Ms. Lu initially told a Delta agent that another passenger had touched her leg inappropriately. Delta immediately reported the incident to local and federal law enforcement. "Delta is aware of Ms. Lu's lawsuit and intends to fight it."

A Los Angeles International Airport Police spokesman told Fox News that police responded to reports of inappropriate touching in-flight and met with the victim and a Delta representative upon the plane's arrival at its destination. “The preliminary investigation has been completed and no arrests have been made,” a police spokesman confirmed.

Airport police also reported that Delta did not contact them before the plane arrived and did not detain the suspect. However, the police claim that the airline could not have the right to detain anyone against their will, unlike the police.

Lu intends to seek $6 million in damages—$1 million in compensatory damages and a $5 million fine in the lawsuit.
