In Russia, they decided to limit the number of children in the family: what will this lead to?

A day after the promises of the Minister of Education Olga Vasilyeva to tighten the rules for adopting children, it became known that her department was sending the bill to regional ministries.

On receipt of the bill for approval and proposals Air force told two regional ombudsmen for children. Its text is available to the editors.

One of the first documents that is actively distributed through social networks was published by lawyer Anton Zharov. In a comment to the BBC, he said that he also received it from a regional official.

The press service of the Ministry of Education at the time of publication of the material did not respond to a request for comment.

What does the bill offer?

• If the family adopts a child, the total number of children, including relatives, should not exceed three. Exceptions: if adopting brothers and sisters; children previously under care; children who were adopted earlier and brought up together.
• You can only adopt one child at a time. The exception is when it comes to brothers and sisters.
• People wishing to accept a child into their family must undergo a psychological examination. This must also be done by capable adults living with them, and by the child himself (for children over 14 years old - with their consent).
• Permission for adoption by people with HIV and hepatitis C will be issued by the court, which will have to decide whether it is in the interests of the child.
• The permission to change the place of residence of minor adopted children will be issued by the tutorship and guardianship authorities.
• The law may come into force on January 1 2020.

Why do it?

On Thursday, 16 August, the head of the ministry Olga Vasilyeva promised to tighten the rules for the selection of foster families for orphans.

“We will tighten the selection of parents, we will tighten it very well. The requirements for candidates for the high title of parents are being tightened. And the requirements for psychological examination of people who want to become adoptive parents are being tightened,” the minister said.

She explained that such proposals are related to the analysis of cases of violence and murder of children in foster families. “All the tragic cases of new (adoptive) families this year have led to a disappointing conclusion: the selection of future adoptive parents was very careless,” she noted.

When asked whether, in her opinion, it is worth allowing people with HIV to adopt children, Vasilyeva replied: “I’ll tell you honestly: I’m far from this idea.”

According to the Ministry of Education, today in the data bank of orphans there are 48 thousands of questionnaires. About 50 thousand people annually lose their parental rights.

At the beginning of August, the reform of the guardianship and custody bodies called for Anna Kuznetsova, a children's ombudsman. She made this statement after the murder of a girl by her adoptive father in Tatarstan.

What will the adoption of the law?

Prohibitive measures to limit the number of children and the requirement for family members to come for examinations in the first few years will definitely reduce the number of adoptions, Elena Alshanskaya, president of the Volunteers to Help Orphans Foundation, told the BBC.

At the same time, this in itself is neither good nor bad, Alshanskaya emphasizes: “We do not have the task of counting pure numbers. Children are not math. We don't have to solve problems of "decline" or "growth". Our task is to provide a high-quality device for the child. The question is that children receive help and families receive help - blood families in the first place, so that children remain there. And foster families so that the children adapt,” she says.

According to Alshanskaya, there should be a special approach to families that take a large number of children.

“There are situations when parents cannot cope. When a group [of children] comes to a family at once, it is quite difficult and risky. It’s harder for parents; they have fewer resources. Therefore, the decision must be conscious: why are you taking such a large number of children? Does the family really have enough pedagogical and material resources? And, of course, we need support.”

At the same time, Alshanskaya emphasizes that simply limiting the number of children will not correct the situation of child abuse: “Violence and cruelty occur in families with one child, or two, or three.”

The effectiveness of the psychological examination stated in the bill depends on how this practice will look.

“Resources need to be assessed, rather, at the moment when we are talking about a specific child and we are assessing the resources of this particular family in relation to this particular child, and not spherical resources in a vacuum,” the BBC interlocutor noted.

According to Alshanskaya, in this sense, psychological assessment could be a useful tool for families in realizing their own resources. At the same time, the examination should not turn into a procedure that puts an end to the decision whether to give or not to give to the family of the child.
