In the US, re-executed the killer who survived the first attempt of execution

The US Supreme Court refused to consider the appeal of sentenced to death 60-year-old Romell Broom, who was unsuccessfully tried to execute in 2009 year.

The executors of the death sentence could not get a needle into the vein of Broome to inject a lethal injection, now they will try to carry out the sentence again, reports Reuters.

Broome was sentenced to death for raping and murdering an 14-year-old girl in 1984.

During the execution in Ohio, the prison team spent about 2 hours trying to inject a lethal injection to a convicted person. Brum 18 once injected the needles into the arms and legs, in some cases, the jailers touched the bone, which caused severe pain.

After an unsuccessful attempt to execute, the lawyers of the convict appealed against the death sentence on the grounds that, according to the law, no one could be punished twice for the same crime.

The defense also argued that retrying should be regarded as cruel treatment of a person prohibited by the US Constitution.

Before the lawyers appealed to the US Supreme Court, the Ohio Supreme Court considered the case, rejecting the complaint, citing the fact that in 2009, Broome was not actually executed: the drugs that are part of the lethal injection did not begin to act.

According to Sky NewsRomell Broome is only the second convicted person in the USA who survived an unsuccessful attempt at execution. In 1946, in Louisiana, the death sentence of 16-year-old assassin Willy Francis could not be carried out. A prison guard and one of the prisoners participated in the execution procedure. Being drunk, as Francis's lawyer argued, they incorrectly plugged an electric chair. Francis's sentence was re-enforced in 1947.

To date, the death penalty is provided for by the US 31 laws, but most of the executions are for only a few: Texas, Alabama, Missouri, Florida and Georgia.
