In a nursing home on Long Island, a patient was killed and then billed to his relatives

First, an elderly man was killed in a nursing home on Long Island, and now the institution has sued his family because of a possible debt for services.

According to the court’s decision, the Nursing Center in Woodhaven is obliged to pay a million dollars to the family of a deceased disabled person, Salvatore Niosi, after the nurse forgot to put dentures on him and fed the patient with a sandwich, which caused him to choke.

"Choke to death is a terrible way to die," said Clifford Arguintar, a lawyer for the 82-year-old grandfather's family.

But the nursing home does not give up and claims that the family owed money to the institution for the care of the alleged technical error with an application for Medicaid.

According to Argintar, an elderly man was in the institution for six years because of several heart attacks, after which he was paralyzed so badly that he could not properly speak and swallow.

The patient’s medical record indicated that he could only eat mashed potatoes.

But 13 December 2013, a nurse at Woodhaven Care, fed him a sandwich without reading his appointment or even inserting dentures. He panted for 3 minutes, relatives said.

According to their lawyer, it took the staff half an hour to call 911.

Later in the autopsy report, it was stated that Nyoshi’s death was due to choking with “food material in the airways”.

Nyosi's daughter, Sylvia Teysier, filed a lawsuit against a nursing home in June 2015.

The institution admitted its mistake on the eve of the trial. The jury only needed to decide how much money the Center should pay to relatives for Niosi’s suffering. It took them four days to evaluate a patient’s suffering of a million dollars.

Teiciera said her father died 10 months before her daughter was born.

“It would be good if he knew that he has another granddaughter,” said the mother of four children.

“It’s sad that he had to go through that and that I wasn’t there,” added the 41-year-old Miller Place woman.
