The Constitution prohibits the head of state from receiving monetary and other remuneration from foreign states without the consent of Congress, while he is in the line of duty.

The plaintiffs claim that Trump has violated this situation, since foreign embassies and officials stop at the hotel that bears his name.

Trump did not provide Congress with any details regarding these events, and did not ask the legislators for their consent. The White House’s position boils down to the fact that these shares do not fall under the concept of “reward”. The administration believes that we are talking about ordinary commercial transactions, and not about personal payments.

For their part, the plaintiffs, as stated in their statement, do not know whether regular commerce or personal offerings take place here, since Trump did not disclose any details regarding the stay of foreign representatives at his hotel.

In February, the company that owns the Trump hotel in Washington, DC, donated more than 150 thousand dollars to the Treasury as a donation, qualifying this amount as “profit” from transactions with foreign countries. The company's accountants did not attach an explanatory note to their statements.

Note that when Trump’s presidential term was just beginning, many wondered if the presidency was in conflict with his business interests.

As he wrote TASS, shortly before the inauguration, Trump transferred control of his family company, the Trump Organization, to his sons, Eric and Donald Jr. At the same time, profits received from foreign governments still had to go to the accounts of the Ministry of Finance.

In March last year, the company announced that it would begin transferring funds there not earlier than 2018, since the hotel’s management cannot determine who among the guests of the numerous hotels owned by the Trump Organization is a foreign official and pays for his stay at the expense of his state.

As wrote BBC Russian Service, the hotel in the District of Columbia has one more interesting feature. The building is owned by the federal government, and the Trump Organization rents it.

Ornstein, of the American Institute of Business Norm, considers this a violation of the rewards clause.

“The clause very clearly states that, other than his salary, the president should not receive any additional income from the federal government or the states. The rental of the Trump International Hotel is, by all indications, something of great value, which he receives from the federal government,” the expert says.

However, in March, the US General Services Administration (GSA), the agency whose head was appointed by Trump, ruled that the Trump Organization was not in violation of the terms of the hotel's lease.

The contract clause that was signed by the Trump Organization in 2013 prohibits renting a hotel from elected officials who benefit from it.

But the GSA said that since the hotel will not transfer profits to the Trump Trust until the end of its presidency, it does not violate the terms of the lease.

At the same time, ethical experts believe that Trump will continue to profit from a successful hotel after leaving the presidency.

The Ministry of Justice, in turn, argues that the clause on remuneration does not apply to operations that are part of the business of an enterprise.
