The court forbade Trump to block followers on Twitter for criticism

US President Donald Trump has no right to block in his microblog Twitter users who leave comments there criticized him.

Judge Naomi Buckwold decided that blocking Trump's followers on the page is anti-constitutional and violates the provisions of the First Amendment to the US Constitution, which guarantees, in particular, the right to free speech and protest.

According to Buckvold, the court was deciding whether "an official can, without violating the First Amendment, ban a Twitter user for expressing political views" and whether the fact that the official is the president of the United States makes a difference. “The answer to both questions is no,” Buckvold emphasized when announcing the court’s decision.

“While we must recognize the President's First Amendment rights, he cannot exercise those rights in a manner that would violate the First Amendment rights of those who criticize him,” the judge said in his ruling.

The president’s advocates argued that blocked people can still access the president’s tweets, and therefore can read his microblogging as a policy discussion platform. But the court noted that prohibiting users from directly interacting with him in Twitter (blocking deprives them of the right to comment on Trump's notes), the president deprives them of the right to express their thoughts on public policy, which means the right to freedom of speech.

A lawsuit against Trump was filed in July 2017 by seven Trump blocked users. Twitteras well as a human rights organization Knight First Amendment Institute at Columbia University. It argued that Trump, blocking subscribers to his page in the microblog, violates the provisions of the First Amendment to the US Constitution.

According to the plaintiffs, since Trump uses Twitterin order to come up with various political statements, his microblog serves as a platform for public disputes and discussions, and the authorities cannot deny people access to it, based on their views.

After the inauguration, Trump began using an official presidential account in Twitter, but at the same time continues to publish messages on his personal page in the microblogging, actively using it to express his thoughts and plans.
