Trump tightens visa extension for foreign workers

The US government is tightening the process of updating a popular visa for foreign workers.

This week, the United States Citizenship and Immigration Services (USCIS) advised their officials to “apply the same level of control” to requests for an extension of the H-1B visa, writes CNN.

In other words, officials are required to consider requests for renewal as carefully as initial visa applications.

H-1B is a common visa for highly skilled foreign workers in US companies.
It is valid for three years and may be extended for another three years. This is a program that is particularly close and dear to the technical community, and many talented engineers fight for one of the X-NUMX 85 visas H-000B every year.

The directive repeals the previous guideline, which gave "respect" to previously approved visas "until the key elements have changed and there is no evidence of a significant error or fraud associated with the previous definition."

“This updated guidance provides clear guidance to help advance policies that protect the interests of American workers,” said new USCIS Director Francis Cissna, who was sworn in this month. President Donald Trump announced his intention to nominate Cissna last spring.

In April, Trump announced a “Buy American, Hire American” strategy that included new rules and guidelines to prevent fraud and abuse of work visas. The H-1B program in particular is something President Trump has criticized because companies use the visa to replace American workers.
Other visas that are affected by the new guidelines include L-1, for specialist translation and O-1 for people with “extraordinary abilities”.

Some say that the new policy will be overly burdensome and aimed at restricting foreign workers.

Betsy Lawrence, director of government relations for the American Immigration Lawyers Association, told CNN Tech that the previous recommendations allowed for an efficient review of cases. Even then, USCIS has the right to question previous decisions and to request additional information when considering extensions.
