A family from New York will receive $ 26 million from the hospital for negligent pregnancy

It took the jury just eight hours to award a couple of Brooklyn 26 million dollars - twice as much as they demanded after being crowded Maimonides Medical Center Because of the negligence of the doctors, one of their twin girls died, and the second was born deaf and dumb.

"It's like a baby assembly line," mom Danielle Madden Buck said of the hospital Borough park, which at that time was the most crowded maternity ward in the state.

Nightmare Buck started 9 February 2010, when she was at 20 week of pregnancy and went to the hospital in the morning with cramps and bleeding, according to a lawsuit.

The doctor examined her and sent her back to Mill Bassin. By evening, the bleeding increased, so she returned to Maimonides. Another young doctor checked her, but “there was no change—they weren’t worried,” Buck said.

But mom was very worried. After in vitro fertilization (IVF), she initially became pregnant with triplets, but the doctors said that there is a much higher survival rate of the fruits if there are only two embryos. She was sent home again.

“I called the doctor and said I was still worried about the bleeding. She told me not to worry about it,” Buck said.

Buck did not return to the hospital until February 17, when the study was planned, but by that time it was too late. The head of one fetus was enlarged.

"They shouldn't have sent her home," said Buck's attorney James Wilkens. She added that the young specialist who examined Buck was sent to the patient because more experienced doctors were busy.

When the girls - first Aleyga, then Madeleine - were born, they weighed about 450 g (1,5 lb) each.

A month later, Madeleine died from an infection. Buck was able to hold it only once. Aleiga survived, but she is deaf, cannot speak and suffers from renal failure.

Buck and her husband Andrew sued the hospital, demanding 13,5 million dollars for negligence.

After 8 hours of discussion, a jury of three men and three women awarded them 26,19 million dollars.

The jury did not know about the so-called “high” deal between the parents and the hospital.

According to this deal, the plaintiffs agreed to receive $ 7,5 million if they win their claim and $ 1,5 million if they lose. The agreement would save a couple from having to appeal if they lost, while leaving them some money to care for Aleyga, their lawyer said.
