Much depends on the judge and the state: who and where in the US most often refuses asylum seekers
The chances of obtaining asylum in the United States depend primarily on the validity of the application, often also on the availability of a lawyer (he knows how to properly collect and submit the necessary evidence to the court). Courts in the USA refuse almost 90% of applicants without lawyers, while among those represented by a professional immigration lawyer, the refusal rate is less than 50%.
But the city in which you applied for asylum and the immigration judge assigned to consider it also play an important role. At least that's what the data shows. register of decisions of immigration courts on asylum applications for 2017-2022. From them, the conclusion suggests itself that in some cities it is better not to apply for asylum, and it is better not to get to some judges.
In which court is the most difficult to obtain asylum
If you apply for asylum in Atlanta, Georgia, then the chance of being rejected is very high. From 2017 to 2022, all judges there denied asylum to an average of more than 90% of asylum seekers.
Ryan Fisher turned out to be the kindest - he had an 88,1% refusal rate.
In Houston, Texas, the situation is a little better, but there are still a lot of refusals. The most greedy judge also works there Bruce Imbaquan. In five years, he handled 105 asylum cases and approved none.
Not very accommodating judges in New Orleans (Louisiana).
Generous Judges
If you applied for asylum in Philadelphia (Pennsylvania), then the chance of receiving it is about 50% (depending on the judge).
The most favorable city for applying for asylum is Sacramento (California), where less than a third of applicants are rejected. It also has one of the most generous immigration judges - Robert Maggard. Of the 166 cases that he considered from 2017 to 2022, he turned down only 11 people.
The kindest judges work in San Francisco. Below in the table are nine judges who have denied asylum to less than 10% of applicants.
It is noteworthy that one of them is Isla Deiss — reviewed 1393 cases (this is more than the bulk of the judges on the list), and rejected only 132 applicants.
The most generous immigration judge is one who works in San Francisco Louis Gordon. Out of 208 cases, he turned down only two asylum seekers, less than 1%.
But make no mistake about San Francisco: the city also has judges who have turned down over 90% of asylum claims.
