Thanks to a California Supreme Court decision, many state employees will receive more

The California Supreme Court unanimously ruled that employers must pay employees for the few minutes they spend opening or closing offices, shops, restaurants, etc. before or after their official working hours.

The ruling was the result of an appeal from the federal appeals court to clarify California labor law, writes LA Times.

The court decided that California laws "do not allow employers to require employees to work at an inopportune time without compensation."

The 9 District Circuit Court of Appeal, which asked the state Supreme Court to clarify labor laws, is considering a lawsuit against Starbucks from one of the employees of the network who spent several overtime minutes each evening closing the cafe in which he worked.

A federal district judge rejected the claim, citing the federal rule “de minimis”, which prohibits compensation for small periods of extra-hour working time.

The appeals court asked the Supreme Court to clarify state law, and whether the “de minimis” federal rule could apply to employees in California.

The Supreme Court ruled that this rule does not apply to staff and it is necessary to pay for “all” work time, since a few extra minutes can accumulate every day for quite a long period of work.

The former Starbucks employee who filed the lawsuit worked 17 hours and 12 minutes off-hour for 50 months. With a minimum salary of 8 dollars per hour, the company owed him 102,67 dollars.

Brian Lazarsky, representing workers in labor disputes, called this resolution "an excellent solution for employees."

He said that this decision can make a big difference because many jobs require employees to spend a few minutes on small tasks before or after their work day officially begins or ends.

He stressed that individual requests that took a few seconds, of course, do not have to pay. But regular tasks employers will have to pay.
