US Immigration Changes Foreign Work Visa Process

US Citizenship and Immigration Services announced the successful completion of the pilot testing phase of electronic registration for participation in the H-1B visa lottery - the next visa lottery for fiscal year 2021 will be held under new rules.

Employers wishing to file petitions related to the H-1B limit for the 2021 financial year, including those eligible for a preferential level, must first register in electronic form and pay the corresponding registration fee in the amount of 10 dollars, is reported on the official website USCIS.

The electronic registration process will greatly simplify processing by reducing paperwork and data sharing, as well as provide overall cost savings for employers.

Under the new rules, employers looking for H-1B employees who are subject to the restriction, or their authorized representatives, must go through a registration process that requires basic information about the company and each requested employee.

USCIS will open the initial registration period from 1 to 20 on March 2020. And already for these electronic registrations a traditional lottery will be held with a random selection of those who will get a visa. Only those with such registrations will have the right to petition H-1B.

Historically, employers submitted their full and often voluminous petitions to the USCIS with a restriction of H-1B, after which USCIS selected acceptable petitions by random selection. This process led to unnecessary paperwork and costs for both petitioners and the agency.

“By streamlining the H-1B applicant selection process through the new electronic filing system, USCIS is providing cost savings and efficiencies for applicants and the agency as only selected applicants will now be required to file a full petition,” said USCIS Deputy Director Mark Coumans. “The agency has successfully completed the pilot testing phase, which included meetings with industry representatives, and the implementation of the registration system will help modernize USCIS from a paper-based to an online agency.”

USCIS will publish step-by-step instructions on its website informing you on how to complete the registration process, along with key dates and deadlines as you approach the initial registration period. USCIS will also hold public awareness events so that registrants and interested parties familiarize themselves with the new system. The Agency may decide to continue accepting registrations or open an additional registration period if it does not receive a sufficient number of electronic registrations and subsequent petitions.

DHS has formally created an H-1B registration requirement for rulepublished on January 31 and entered into force on April 1 on 2019 of the year. In the coming weeks, DHS plans to publish a notice on the Federal Register to officially announce the introduction of the H-1B registration system and provide additional information about the process.

On 8 on November 2019, DHS published the final rule establishing an H-1B registration fee of $ 10. The final registration fee rule will enter into force on December 9 of 2019 and will apply to registrations submitted during the initial and future registration periods.
