The second judge blocked Trump's decision to terminate the DACA program: what does it mean

The second federal judge temporarily blocked the decision of the Trump administration to terminate the DACA program.

Judge Nicholas Hourefis from the US District Court for the Eastern District of New York blocked the Trump administration’s decision to terminate the DACA program, writes CNN.

Last year trump объявил its intention to end the DACA program, the policy that allowed immigrants who do not have the documents that their parents brought children to the United States to stay in the country. The suspension of the program should occur 5 March. This extreme period has become central to the debate on immigration in the Congress.

A court ruling on Wednesday, February 14, means that the program will continue to operate even after March 5. This means that DACA recipients can update their status, but it will not be available for those who have never registered for it.

“Defendants are indisputably able to terminate the Daca program,” Garoufis wrote to the Trump administration. “Thus, the question before the court is not whether the defendants can terminate the DACA program, but whether they have provided legally adequate reasons for doing so. Based on the available record, the court finds that the defendants did not do so.”

The judge said that the decision to terminate the program was partly based on the “clearly wrong factual premise,” according to which the program was illegal.

“Today’s ruling shows that courts across the country agree that Trump’s ending of DACA was not just immoral, but illegal,” said Karen Tumlin of the National Immigration Law Center.

This week, the Supreme Court is meeting behind closed doors to discuss whether to consider the appeal of the Trump administration in the relevant case.

The Department of Justice stated that it claims that the administration acted “within its legitimate authority” when deciding to terminate DACA’s activities and “would strongly defend this position”.

“DACA was implemented unilaterally after Congress refused to extend these benefits to this same group of illegal aliens. Thus, this was an unlawful circumvention of Congress,” the Justice Department said in a statement. “Promoting and ensuring the rule of law is vital to protecting the nation, its borders and its citizens.”

The essence of the program

Young immigrants who are subject to the DACA, who in most cases entered the United States at the age of six years - usually from Mexico and the countries of Central America - are known as “dreamers” (Dreamers). For the most part, they did not know another homeland, except the United States. Thanks to the anti-deportation program, they are now studying, working or serving in the US military.

If Congress does not take legislative measures to protect them, then 5 in March 2018 (after the 6 month transition period expires) will be deported.
