The authorities in New York refuse to recognize the biological parents of a “surrogate” child

The couple from Manhattan has been defending the right to be listed as parents in the birth certificate of their biological child born to a surrogate mother for six months.

At the moment, Stephen and Angelina Cates have already filed a second lawsuit against the New York Department of Health, which refuses to recognize their son Michael, the legitimate parents, writes New York Post.

The baby is the fruit of Stephen’s sperm and Angelina’s egg cell. The embryo was implanted in Angelina’s cousin’s womb, but in the eyes of the government, according to the laws of the state of New York, the child belongs to the woman who carried it out, despite the fact that Angelina’s cousin wrote a waiver from him.

The Cates filed their first claim that the couple would like to see their names on the child’s birth certificate immediately after the birth of their son, on July 22, 2015.

But the lawsuit was returned to them, motivating it with the fact that the documents should be submitted electronically, now the couple is awaiting trial.

“The idea that Elena Klimova and Alexander Klimov would be listed on the birth certificate as the parents of my child is offensive to me and my wife,” Stephen Cates said during the proceedings.

The surrogate mother Elena Klimova stressed during the court session: “I have my own children who are genetically related to me and I don’t want to be mentioned as a mother of a child with whom I have no genetic connection and interest in his upbringing.”

According to court documents, Angelina Cates is unable to have children “for medical and psychological reasons,” which are not listed.
