Legal use of marijuana: what you need to know

On Tuesday, in several states, in addition to the presidential elections, local residents also voted in a referendum on the legalization of marijuana. California, Nevada and Massachusetts voted in favor. Counting is still underway in Maine, but it looks like there will be an affirmative decision there too.

Now in these states, the use and distribution of marijuana by adults is allowed. Not so simple. There are quite a few subtleties in the laws that must be observed. State News gathered major.

Cannabis use at universities and campuses

Since universities - private and public - receive support from the federal budget, they are subject to all laws at the federal level. This includes a ban on the use and distribution of marijuana. For example, Washington State University, after legalizing marijuana in 2012, strictly prohibited the use of cannabis on campus. Similar rules will apply now.

Cars and Marijuana

Driving after using marijuana is still illegal everywhere. The situation with passengers is more complicated. In California, it is illegal for a passenger to even open a bag of marijuana in the cabin. In Arizona they don’t see anything wrong with this, the main thing is not to smoke. But in the state of Nevada, a passenger has the right to smoke marijuana in the car as long as the driver is in adequate condition and can operate the car. In Massachusetts, there is an interesting clarification - you can only keep a closed package in the car, but even an open package of drugs can be stored in the trunk.

Marijuana in the workplace

Smoking marijuana is only allowed at home. Consumption in the workplace is, of course, prohibited. Moreover, if the employer finds out about the bias, then he has the right to fire the employee, as this violates federal law. This conflict has already led to the fact that in some states where marijuana has long been legalized, workers are suing employers for not hiring them because of the use of marijuana “for medical purposes.” The publication also clarifies that in Maine, employers are prohibited from punishing an employee if he uses marijuana outside the company's premises.

Marijuana Cultivation Fields

Marijuana fields must be protected. California, Massachusetts and Nevada require special barriers to prevent outsiders from entering the plantation. Also among the requirements is that marijuana should not be visible from the outside.

Distribution of marijuana

It is prohibited to sell large quantities of marijuana, the states only allow trafficking in a small amount of the drug. At the same time, public dissemination of information about the sale is prohibited.

Marijuana for owners of preferential housing

Since many housing benefits and subsidies are paid for by the federal budget, low-income citizens who benefit from such programs are prohibited from smoking marijuana even in their homes - again because it violates federal law. Violators may be evicted. Federal authorities clarified in 2011 that eviction is not mandatory, but a landlord can do so if they choose.
