USCIS will expedite the issuance of certain visas and green cards

Biden administration announced about plans to expand expedited processing to some of the important green card and visa categories that are associated with the education of international students.

The expansion of these categories will be implemented in stages, starting with the accelerated processing of applications for EB-1 and EB-2 green cards.

This will be in addition to any previously filed Form I-140 under the E13 classification (executives or managers of multinational companies) or the E21 classification (professionals holding an advanced degree or aliens of exceptional ability).

If you want to use the expedited processing service, you must submit Form I-907 (Request for Premium Processing Service).

Beginning January 30, 2023, I-907 forms will be accepted for visa applications in the E13 and E21 categories.

US Citizenship and Immigration Services (USCIS) saidthat this is part of its efforts to improve efficiency and reduce the burden on the overall legal immigration system.

“In March, we will expand expedited processing for certain F-1 student visas, specifically for students seeking optional practical training (OPT) and F-1 students seeking additional STEM training if they already have a pending review Form I-765, Application for Work Permit,” USCIS said.

USCIS appears to have made these decisions based on recommendations from the Presidential Advisory Commission on Asian Americans and Pacific Islanders (AAPI) made last year by one of its Indian American members, Ajay Jain Butoria. .

The Presidential Commission stated that historically expedited processing was only available to applicants who filed Form I-129 Petition for Nonimmigrant Worker and Form I-140 Immigrant Petition for Foreign Worker.

“We recommend expanding premium processing services by giving applicants the option to pay upwards of $2500 to expedite the processing of their applications,” it said in a statement.

Among the forms recommended for premium processing were I-539 (Application to Extend/Change Nonimmigrant Status) and I-765 (Application for Employment Authorization).
