USCIS Mandates Electronic Filing of Certain Forms: How the New Rule Will Work

The US Department of Homeland Security (DHS) on its the official website announced it was introducing a rule allowing U.S. Citizenship and Immigration Services (USCIS) to make electronic filing (or online filing) mandatory for certain immigration forms.

Under this rule, USCIS will be able to require any immigration form for which electronic filing has been available for at least 180 days to be filed online. USCIS will notify the online filing requirement for a specific form at least 60 days before it becomes mandatory to file electronically on its website.

To submit an immigration form to USCIS, applicants will need to use an online account: either fill out the form directly in the system or upload a PDF file containing the completed form and relevant supporting documents.

This initiative will eliminate the need for physical document processing through U.S. Treasury services and accelerate the transition to electronic fee payment. This transition is expected to significantly reduce costs and improve efficiency for the federal government.

Electronic filing, compared to paper forms, simplifies the collection, storage, and access of data. This will improve fraud detection, simplify identity management, and improve the efficiency of audits thanks to faster access to information and expanded analysis capabilities. Furthermore, electronic filing reduces errors and incomplete applications, and reduces decision-making time. As a result, case processing becomes more secure, transparent, and efficient.

Electronic filing is already widely used for many USCIS forms. Electronically applying for immigration benefits is not a new method for filing documents for foreign nationals. Applicants who are unable to file documents electronically may request a waiver from this requirement. USCIS has the discretion to grant such a waiver if electronic filing creates undue burden.

The new rule became effective on August 11, 2026. DHS will accept and consider public comments received no later than October 13, 2026.
