USCIS will publish new versions of Forms I-539 and I-765; old versions will soon be discontinued.

On September 15, 2026, U.S. Citizenship and Immigration Services (USCIS) will release updated versions of Form I-539 (Application to Extend or Change Nonimmigrant Status) and Form I-765 (Application for Employment Authorization). Both forms will be dated September 15, 2026, according to official website of the department.

The forms have been updated to reflect the recently published final rule, which establishes a fixed period of stay and extension procedures for international students, exchange visitors, and foreign media representatives.

The September 15, 2026, revisions of Forms I-539 and I-765 replace the August 28, 2024, revision of Form I-539 and the August 21, 2025, revision of Form I-765. There is no transition period for the new revisions, as these forms are required for the final rule to apply.

Because there will be no transition period, USCIS is releasing preview versions of Forms I-539 and I-765, as of September 15, 2026, along with instructions, in advance. Forms as of September 15, 2026 cannot be submitted before September 15, 2026. USCIS will only accept forms as of September 15, 2026, if they are mailed or filed electronically on or after September 15, 2026.

When filing Form I-539, please be aware that USCIS will proceed as follows:

• will accept Form I-539 as amended on 8/21/2025 if mailed or filed electronically before September 15, 2026;
• reject Form I-539 as amended on 8/21/2025 if it is mailed or filed electronically on or after September 15, 2026;
• will only accept Form I-539 as amended on 9/15/2026 if mailed or filed electronically on or after September 15, 2026.

When filing Form I-765, please be aware that USCIS will proceed as follows:

• will accept Form I-765 as amended on 8/21/2025 if mailed or filed electronically before September 15, 2026;
• reject Form I-765 as amended on 8/21/2025 if it is mailed or filed electronically on or after September 15, 2026;
• will only accept Form I-765 as amended on 9/15/2026 if mailed or filed electronically on or after September 15, 2026.
