USCIS changes rules for issuing H1B work visas

US Citizenship and Immigration Services (USCIS) On January 30, it announced changes to the issuance of work visas. The service will reduce the likelihood of fraud in the H-1B registration process. Everyone will have the same chance of being selected, regardless of the number of applications and the date of registration.

Improvements in these areas should make the H-1B process fairer for petitioners and beneficiaries. This will make the H-1B application process completely electronic.

H-1B Registration Rules

Now everyone will have the same chance of being selected, regardless of the date of registration and the number of registrations submitted on their behalf by the employer. Beginning registration in FY 2025, USCIS will require registrants to provide valid passport information or valid travel document information for each beneficiary.

The passport or travel document must match the one the beneficiary intends to use to enter the United States if issued with an H-1B visa. Each beneficiary must be registered on only one passport or travel document.

USCIS will be able to deny or revoke H-1B petitions if the underlying registration contained a false certification or was otherwise invalid. Also under the new rule, USCIS may deny or revoke approval of an H-1B petition if the service determines that the fee associated with the filing is denied, inconsistent, disputed, or otherwise invalid after filing.

USCIS also announced final rules Fee Schedule. This rule will take effect after the initial registration period for H-1B for FY 2025. The registration fee for the registration period beginning March 2024 will remain $10.

The new Form I-129 with final changes will soon be available for preview on the website uscis.gov (date 01.04.24/1/2024). Effective April 129, 01.04.24, only Form I-XNUMX dated XNUMX/XNUMX/XNUMX will be accepted.

FY 1 H-2025B Initial Filing Period

H-1B registration for FY 2025 will open at noon ET on March 6, 2024 and will continue until noon ET through March 22, 2024. During this period, potential applicants and their representatives must use a USCIS online account to electronically register each beneficiary.

Online filing of Forms I-129 and I-907

On February 28, 2024, USCIS will launch new entity accounts in the USCIS Online Account. They will allow multiple people in an organization and their legal representatives to prepare H-1B registrations, H-1B petitions, and the associated Form I-907.

Also on February 28, USCIS will launch online filing of Form I-129 and the associated Form I-907 for H-1B petitions. On April 1, USCIS will begin accepting online submissions of H-1B petitions and associated Forms I-907 for petitioners whose registrations have been selected.

Applicants will still have the option to file a paper petition on Form I-129 H-1B and Form I-907. However, during the initial launch of organizational accounts, users will not be able to link paper Forms I-129 and I-907 to their online accounts.

USCIS will increase the Form I-907 filing fee beginning February 26, 2024. If USCIS receives a Form I-907 postmarked on or after February 26 with an incorrect fee paid, it will reject the Form I-907 and refund the filing fee. For documents sent by commercial courier service (such as UPS, FedEx and DHL), the postmark date is the date shown on the courier receipt.
