Illegals will be taken into account in the population census: the court forbade Trump to exclude them

Three federal judges in New York on Thursday, September 11, ruled that US President Donald Trump's decree to exclude illegal immigrants from the census was illegal. Writes about it USA Today.

Trump's July memo argued that illegal aliens should not be counted in the census to determine the number of members of Congress from each state.

The court ruled that his order violated federal laws governing the distribution of congressional seats. Apportionment is the process of deciding how many seats in the House of Representatives each state will receive based on that state's population.

The judges issued an injunction to overturn the order, stating that the damage caused to them would last for decades.

“We declare the presidential memorandum unlawful,” the three-judge panel ruled unanimously.

The judges forbade Commerce Department chief Wilbur Ross from excluding people who are in the country illegally when transmitting the 2020 census data used to calculate the number of seats in Congress.

The court ruled that individuals who are in the country illegally are considered people to be counted in the states in which they live.

“Throughout the history of the country, the census has included the “total population” and the “total number of persons” in each state—it has counted every person living in the United States at the time of the census, whether he is a citizen or a non-citizen, and regardless of whether he lives here legally or not,” the judges said.

The Trump memorandum has been contested by dozens of states, cities, counties and groups representing minority communities. The American Civil Liberties Union argued that the change could cause some states to lose their congressional seats if illegal immigrants are not counted.

“This is a huge victory for voting rights and immigrant rights,” Dale Ho, director of the ACLU Voting Rights Project, said in a statement. — President Trump tried to use the census against immigrant communities, but failed again. The law is clear—everyone is counted in the census.”

The Thursday 11/XNUMX ruling was another major defeat for the White House in court, as the July decree was inspired by Trump's failed attempt last year to add citizenship to the census.

In June 2019, the Supreme Court ruled against the issue of citizenship: the reasons why the Trump administration wanted to include him in the census turned out to be "far-fetched."

In addition to this litigation, the Trump administration has faced lawsuits over a directive to cut the 2020 census schedule that has already been violated by COVID-19.

The deadline was pushed back to 30 September because, according to the census, it was the only way to tabulate the numbers in time to meet the "statutory deadline of December 31, 2020, as required by law."

On Labor Day weekend, a federal judge in California blocked an order from the Trump administration to immediately wind down census operations.
