The court ruled on Trump's health insurance rule for a U.S. visa
A federal judge in Oregon has blocked one of the immigration rules of the US Presidential Administration Donald Trump, according to which, immigrants who do not prove that they can afford medical insurance will be refused a visa. Writes about this CNN.
Judge Michael Simon ruled that “A presidential proclamation requiring legal immigrants to present proof of health insurance before issuing a visa by the Department of State does not comply with immigration laws.”
Simon had previously issued a temporary ban on this rule of administration, and now has issued a nationwide preliminary injunction pending resolution.
The health insurance that immigrants must buy includes employer-sponsored and family coverage plans, unsubsidized individual health insurance plans, and short-term plans, but not subsidies from the Medicaid or Affordable Care Act.

Simon’s order comes from a lawsuit filed by a group of US citizens who claim that politics actually serves as a new form of “family separation.” They argue that the rule may lead to the separation of families who immigrate on family visas.
Esther Song, a senior bailiff representing the plaintiffs, said she was “grateful for this court ruling that would allow families to reunite.”
According to the Kaiser Family Foundation, in 2017, three quarters of the 27,4 million uninsured under the age of 65 were US citizens.
As ForumDaily wrote earlier:
- President Donald Trump signed a decree banning immigrants from entering the countryunable to pay the cost of their health care. Immigrants must have the necessary financial means upon entry into the country or guarantee that they will receive health insurance no later than 30 days from their arrival in the United States.
- On October 15, October 2019, U.S. President Donald Trump’s administration rules will come into force, which may to prohibit the issuance of green cards to immigrants using Medicaidfood stamps or other forms of government assistance.
- US Federal Judges in New York, California, and Washington blocked the implementation of the rule introduced by the Trump administration. The judges explained that the federal government did not provide evidence of the need to apply this rule, which contradicts the principle of the “American dream”. Immigrant rights groups and several states argue that the new rule is contrary to existing immigration laws and will increase the cost of providing medical and other services to immigrants.
- 2 November federal judge in Portland (Oregon) temporarily suspended the new administrative rule of US President Donald trumpaccording to which immigrants must prove that they have the opportunity to purchase health insurance or can pay for medical care before they can get a visa.
