The US will now deport even more immigrants: new rules have entered into force

The United States Citizenship and Immigration Services (USCIS) continues to implement the updated 28 in June of guidance for issuing notices of the need to appear in the Immigration Court (NTA) to initiate deportation in visa denial cases.

USCIS applies a phased approach to the implementation of this guide, the press service of the agency said.

The NTA is a document that informs an immigrant of the need to appear at an immigration court session. Issuing this document to a person is the first step in the deportation procedure.

Starting in November 19 2018, USCIS may issue NTA along with the rejection of applications in the following forms:

• I-914 / I-914A (Applications for T Nonimmigrant Status; T non-immigrant visa is intended for foreigners who are victims of human trafficking who are in the United States precisely because they have been the victim of such a crime);
• I-918 / I-918A (Petitions for U Nonimmigrant Status; special non-immigration U visa created for victims of various crimes - victims who have been subjected to moral or physical violence, and then began to assist law enforcement agencies in investigating these crimes);
• I-360 (Petition for Amerasian, Widow (er);
• I-929 (Nonimmigrant Petition for Qualifying Family Members, Nonimmigrant Special; Immigrant Special; Violence Against Women Act; Immigrant Juvenile Petitions);
• I-730 (Refugee / Asylee Relative Petition, when it is present in the US);
• I-485 (Application to Register Permanent Residence or Adjustment of Status).

NTA can also be issued in response to any other requests, if the rejection of them provides for the beginning of the deportation process.

USCIS will send opt-out letters to ensure that applicants are given proper notice of rejection of their request. If the legal residence of such applicants in the United States has expired by the time of the refusal, and they do not leave the United States, the USCIS may issue NTA against them. In addition, in a letter to USCIS will provide detailed information about the legal period of stay in the country, the rules for counting them, as well as how and in what time the person must leave the United States.

USCIS Launched the introduction of the new 1 october 2018 manual of the year.. Starting from this day, refusals on forms I-485 (application for permanent residence status or immigration status adjustment) and I-539 (application for extension / change of nonimmigration status) may pull NTA issuance.

USCIS will continue to give high priority when issuing NTA to people who have a criminal record or are threatening US national security. However, this notice may be sent by the Office at its discretion to other applicants.

USCIS will hold a public 15 November newsgroup on 14: 00 EST to provide an overview of the innovations and answer stakeholder questions.
