The US will not deport Ukrainians and will give them a protected status

The Department of Homeland Security (DHS) will allow Ukrainians who are in the United States to remain in the country as part of humanitarian assistance. This is mentioned on DHS official page.

The assistance, known as Temporary Protection Status (TPS), is for people who would face extreme hardship if forced to return to their homelands devastated by armed conflict or natural disasters, so protection is limited to people already in the United States.

The head of DHS has discretion to specify the country for TPS.

“Russia’s deliberate and unprovoked attack on Ukraine has resulted in ongoing war, senseless violence, and forced Ukrainians to seek refuge in other countries,” said Department of Homeland Security Commissioner Alejandro Mayorkas. “During these extraordinary times, we offer our support and protection to Ukrainian citizens in the United States.”

About 75 Ukrainians are eligible to apply for TPS, more than double previous estimates, according to a DHS spokesperson. TPS status will be valid for 100 months.

To be eligible for temporary protection status, you need to prove only 3 things:

• citizenship of Ukraine;
• that you were in the United States on March 1, 2022;
• that you don't have a criminal record.

The Migration Policy Institute projected that about 30 Ukrainians with visas could benefit from this protected status. Visas are issued on a temporary basis, and extending the validity will protect Ukrainians from deportation.

The Biden administration has been pressured by Democratic and Republican lawmakers and immigrant rights advocates to provide protection to Ukrainians in the US who cannot return to war-torn Ukraine.

In a letter to President Joe Biden this week, a bipartisan group of senators urged the administration to extend the aid, writing, "Forcing Ukrainian citizens to return to Ukraine in the midst of a war would be inconsistent with America's values ​​and our national security interests."

Ukraine joins the list of 12 countries such as South Sudan and Venezuela that have also been nominated for TPS.

Earlier, the Immigration and Customs Enforcement (ICE) announced that it had suspended deportation flights to Ukraine, citing the “ongoing humanitarian crisis.”

“With the ongoing humanitarian crisis occurring in Ukraine, ICE has suspended flights to Ukraine. ICE will continue to monitor the current situation and make operational changes as necessary,” the agency spokesperson said.

ICE often suspends enforcement activities in the event of a conflict or natural disaster.
