The US Immigration Service has prepared new rules for the entry of foreign entrepreneurs.

The US Citizenship and Immigration Services (USCIS) has published proposals for a new rule that will allow foreign entrepreneurs to obtain permission to enter and temporarily stay in the United States with the goal of starting a business or conducting preparatory work.

After the publication of the document, which can be found here, in the Federal Register, the official journal of the US government, the public will have 45 days to participate in the discussion.

“The U.S. economy has benefited from the contributions of immigrant entrepreneurs for years,” said USCIS Director Leon Rodriguez. “When enacted, this rule will help grow the economy by expanding immigration opportunities for foreign entrepreneurs who meet specific criteria for creating jobs, attracting investment and generating income in the United States.”

Among other things, the US Department of Homeland Security (DHS) will be able to exercise its right to grant, at its own discretion, entry and temporary residence permits in the US to start-up managers who can bring significant public benefit due to the demonstrated potential for rapid business growth and job creation.

Categories of entrepreneurs to whom the new rules are supposed to apply:

• owners of a significant share in startups (at least 15%), and also occupying one of the key positions in the activities of companies;
• the organizers of startups that have been implemented in the United States over the past 3 of the year;
• Startup organizers who have real potential for rapid business growth and job creation, which need to be proved:
  • obtaining significant investments (at least $ 345 000) from certain qualified US investors with a history of successful investments;
  • receiving awards or grants (worth at least $ 100 000) from certain US government agencies at the federal, state, or local level;
  • partial satisfaction of one of the above points in addition to other reliable and convincing information confirming the startup's potential for rapid business growth and job creation.

If these rules are finally approved, foreign entrepreneurs will have the opportunity to get permission to stay for up to 2 years to start a business or conduct preparatory work.

After this period, entrepreneurs will be able to apply for staying in the US for up to 3 years additionally, if the startup continues to produce results that are important from a social point of view, which should be reflected in the substantial growth of capital, profitability and job creation.

The US Citizenship and Immigration Services, after collecting all feedback from the public after the document is published in the Federal Register, will respond to them. New rules will come into effect only when the final version of the adopted document is published in the Federal Register.
