School girl who was not allowed to use the toilet, sued $ 1,25 million

The court ordered the California School District to pay $ 1,25 a million compensation to a former student who had to urinate in a bucket after she was not allowed to go to the toilet during the lesson.

The incident occurred back in the 2012 year, but court proceedings have ended only now, reports with the BBC.

The Supreme Court sided with the former schoolgirl who filed a lawsuit against the district and the teacher.

In the initial lawsuit against $ 25 thousand, she argued that this incident caused her depression and even led to a suicide attempt.

The district did not recognize the girl's claims. The school stated that the teacher did not want to put the student in an uncomfortable position; she, according to lawyers, mistakenly believed that letting students go to the toilet was prohibited, and vice versa - she was trying to find a way out of the situation, and not create emotional trauma for the child.

The plaintiff, who is now 19 years old, claims to have been asked to go to the toilet during the 25-minute advisory lesson.

The teacher, considering that it was not allowed to go to the toilet during such lessons, sent the girl to the auxiliary room near the classroom, where she could urinate into the bucket and pour the contents into the sink.

“Things like this shouldn’t happen to a 14-year-old girl just starting high school,” said the student’s attorney, Brian Watkins.

According to the girl, this incident greatly influenced her life, she had to change schools twice because of harassment, and she still goes on a special therapy to overcome post-traumatic stress.

In addition to $ 1,25 million, the court also ordered the district to compensate the plaintiff with $ 41 for a thousand medical expenses.

After the incident, the teacher was sent on paid administrative leave; she had not returned to school.

The institution also apologized to the student and her mother and explained to the teachers that it was possible to let the students go to the toilet during any activity.

The school district, for its part, said it was “disappointed” with the verdict and would decide whether to appeal within a few weeks.
