U.S. Restaurants Include Other Unexpected Things in Employee Health Insurance Surcharges
Los Angeles restaurant Alimento has come under fire after a famous podcaster faced extra interest on a bill. 4% is automatically added to the account to finance the health insurance of employees of the institution, reports CBS.

One in six restaurants said they were charging a commission or surcharge on checks to combat higher costs, according to an August poll by the National Restaurant Association.
Alimento owner Zach Pollack wrote on Instagram that the surcharge is common in the restaurant industry. He noted that many Los Angeles eateries have adopted the practice since the Affordable Care Act was passed in 2010. The law requires companies with 25 or more employees to provide health insurance. He added that additional interest can be removed from the account at the guest's request - a fact he prints on every check.

It is becoming more and more common for restaurants to include extra charges, such as those for bread and water, on customers' bills or to offer them tips beyond what a diner would normally be able to offer for service. For restaurants that typically operate on small margins, such surcharges are designed to offset rising food and labor costs, subsidize employee health insurance, and even fight climate change.
Josh Luger, co-founder of the Capital Tacos fast food chain, is asking customers to tip employees. Tips are distributed among employees, each of whom performs mixed work functions.

Such fees, common during the pandemic when restaurants were only allowed to operate at partial capacity, have survived the crisis. And in most cases, restaurant surcharges are perfectly legal as long as they are clearly communicated to customers before their food is delivered.

However, fees can cause confusion for diners, who are more likely to look at prices on a menu to estimate the cost of a meal.
“I have a problem with all of this,” said Brian Warrener, a professor of hotel management at Johnson & Wales University. “These surcharges hide the actual cost of food.”
Not all businesses try to squeeze every last penny out of their customers. And raising menu prices to deal with inflation while providing workers with competitive wages and benefits could also backfire. Warrener said some establishments fear that raising prices on the menu will scare away customers.
“Prices are going up in some places to secure salaries and health insurance. This is confusing to consumers, who are now asking, "Why have your prices gone up so much and why am I paying for something that is none of my business," he said.
Surcharge laws vary from city to city. In New York City, for example, restaurants are prohibited from surcharges or other charges on listed food or drink prices.

By contrast, since 2019, California restaurants have been allowed to charge a 1% commission to combat climate change, although customers can still waive this fee.
