H-1B Work Visas for 2021: USCIS Launches Full Application Process

On April 1, Citizenship and Immigration Services (USCIS) announced the start of the H-1B work visa application process for fiscal year 2021. An employer has the right to file an H-1B petition for fiscal year 2021 only if he previously registered his potential employee online, and USCIS selected this application through random selection (lottery).

The H-1B electronic visa registration process, which was first launched this year, was highly praised by users. Almost 275 applications were submitted during the initial registration period. Approximately 000% of all registrations concerned potential employees with advanced degrees. More than 46 accounts were created, and almost 40% of registered applications related to potential employees from India (000%) and China (81%).

Before launching the electronic registration system, USCIS actively consulted with people on how to use the new system.

“The new H-1B electronic visa registration system has been successful. This streamlined process has reduced the amount of paper and data exchanged between USCIS and employers, said Joseph Edlow, USCIS Deputy Director. - Positive feedback received from users, a small number of technical problems that arose during the registration period, and the ability to immediately answer user questions were the result of integrated efforts for over a year. The new registration system is one of many ways USCIS is improving the H-1B visa program. ”

Each H-1B visa application must be submitted by the deadline specified in the corresponding notice of pre-registration of online pre-registration for this application. The deadline for submitting a full H-1B visa application is at least 90 days. Online submission of full H-1B visa applications is not available, therefore employers must send all in paper form. They should also attach to the package of documents a copy of the corresponding notice about the choice of registration within the online lottery.

The registrations selected by the lottery do not guarantee a visa. The choice in the registration process does not exempt the applicant from the need to present evidence of his right to participate in this program.
