Under current immigration law, fugitives may seek asylum in the United States regardless of how they arrived in the country. The rule proposed by the Biden administration proposes to ban those who crossed the border illegally from applying for asylum in the United States. This restriction will ease the government's deportation process and offload US immigration courts.
The new rule "encourages migrants to take advantage of legal, safe and orderly routes to reach the United States and to seek asylum or other form of protection in the countries through which they traveled to the United States." That is, if a person came to the US border and asked for asylum, but did not try to get protection in Mexico, through which he passed on the way to the States, he would be automatically denied.
The Biden administration released a draft of the new rule on February 21, and the public now has 30 days to comment before it goes into effect. Officials hope this will happen before May 11, before Title 42 (border restrictions introduced during the coronavirus pandemic) expires.
The joint announcement from the Departments of Homeland Security and Justice is the administration's latest move to bolster Biden's position ahead of next year's election. Since taking office, Biden has rescinded and eliminated many of the Trump administration's immigration measures, but has caused chaos at the border. This negatively affected his image and rating.

The new plan carries significant political risks for the president, as such a tough plan has drawn condemnation from advocates for the rights of immigrants, namely, they are the backbone of the Democratic Party's electorate.
Krish O'Mara Vigyaraja, president of the Lutheran Immigration and Refugee Service, said the proposed rule resurrects "one of the Trump administration's most harmful and illegal policies."
“It flies in the face of decades of humanitarian protections enshrined in U.S. law and international agreements, and blatantly violates President Biden’s promises,” she said. “Demanding that persecuted people first seek protection in countries without functioning asylum systems is ridiculous and life-threatening.”

The current US asylum system was created after World War II and the Holocaust. It must ensure that the government does not send migrants back to countries where they can be killed or persecuted on the basis of race, religion, political opinion or membership in a particular social group.
In recent years, huge numbers of migrants have been crossing the US border illegally. They claim that reprisals await them in their homeland, which effectively makes their deportation impossible. To ensure due process, many migrants are released pending trial. But in the end they do not appear at court hearings and live in the United States illegally. With more than 1,5 million asylum applications pending in U.S. immigration courts, the wait takes years.
