Tracy and Miles Albert endured a nightmare after investing in a beautiful four-bedroom home in Riverside on January 31, 2020.

More than a year later, the couple is still unable to move into their home. The previous owner wanted to sell the house immediately, but has since refused to leave the property.

“It’s emotionally and financially draining,” Tracy said.

Chris Taylor, the real estate agent who handled the sale, said the owner demanded over half a million dollars in cash.

“It took us pulling together everything we had, our savings and hard money loans to make this happen,” Miles said. — We completely own the house. This is our home, and all this is stipulated in the contract, written, legal, done.”

“They paid him money into his account. How can we not have the right to enter our home?” - asks the rightful owner.

Attempts to enlist the support of the authorities were unsuccessful, as the rules related to the pandemic did not allow them to forcibly evict the previous owner.

“This transaction took place in January 2020, prior to any of the coronavirus eviction moratoriums. His case does not fall into this at all. This is not a tenant who was kicked out, but a person who collected all this money,” Miles said.

The local eviction prosecutor said the situation was not unusual: there are at least seven cases “of this type”.

An upset Miles says that when he contacted law enforcement, he was told, “If you were in Arizona or Nevada, it wouldn't be a problem, you would just take your home. But in California our hands are tied, although we are on your side, there is nothing we can do. "
