The organization will pay $ 38 fine for selling ID cards to 'protect' from deportation

The immigrant rights organization should pay a fine of $ 38 950 for selling cards that offer protection services against the deportation of undocumented immigrants, an administrative judge said Monday.

The non-profit organization A New Beginning for Immigrants Rights also did not provide a five clients with a written contract, charging them for services that were never provided, Judge Noel Garcia said, NY Daily News.

The organization was founded in 2011 by Carlos Davila, a minister with a criminal record, and began offering ID4ICE membership cards for 50 dollars apiece, claiming that it can help immigrants protect themselves from immigration and customs law enforcement.

“The evidence established that Mr. Davila’s conduct was deceptive and misleading,” Garcia said in a decision released Monday.

Davila was allowed to represent immigrants in federal immigration court, although he is not licensed - a practice the law allows if the person is affiliated with a nonprofit, charity or social service organization.

During the three-day trial, Dawila made it clear that the blue card of his group could scare off ICE agents and simply serve as a “know your rights” card. In promotional videos, Davila advertised the map as a powerful tool.

“Hey, are you afraid of deportation? - they ask the viewer in one of the videos in Spanish. “Under the new executive rules set by the new president, there is a real possibility of arrest at work, at school, in your home... and even in your car!”

The author further claims that the “national identification card” is registered with the federal government. At the end of the commercial, Davila says: “You can be sure that if you remain silent and allow the card to do its work, you will not be deported.”

Judge Garcia found this statement "clearly false and misleading." The 15 minute commercial was published in April 2016 of the year and was active until 26 June 2017 of the year.

In one case, a client identified as Mr. T in the court case said he paid $1700 to file immigration applications for his son. But “the family court did not accept the document drawn up by Mr. Davila,” the judge clarifies.

The testimony against Davil and his organization based in the Bronx was made public as a result of an investigation by WNYC and Telemundo 47 in May 2017.

The investigation noted that in 1998, he pleaded guilty to first-degree manslaughter. During parole, Davila was convicted of sexual assault. He spent 12 years in prison.

Davila denies promising people to save them from deportation or giving other false promises.
