Trump began to sue because of the imposition of a state of emergency

The Public Citizen Consumer Protection Group filed a lawsuit in Washington's federal district court against the decision of US President Donald Trump to impose a state of emergency on the country's southern border.

According to him, Public Citizen appealed to the court on behalf of a group of environmentalists and three landowners from Texas, who were previously warned by the federal government that the wall sections would be built on their lands, writes Correspondent.

The lawsuit alleges that, by introducing the state of emergency, the American leader exceeds his authority under federal emergency laws, and that his decision contradicts the principle of separation of powers.

“Rather than responding to an emergency that requires immediate action, the declaration seeks to resolve a long-standing disagreement between the President and Congress over whether to build a wall along the southwest border, and stems from Congress’ refusal to provide funds for this goal,” the document says.

“Under our Constitution, which is built on the principle of separation of powers, however, a disagreement between the President and Congress over how to spend funds does not constitute an emergency that authorizes unilateral executive action,” the lawsuit states.

As the newspaper notes, this is the first lawsuit challenging Trump’s decision to introduce a state of emergency on the border. It is expected that in the future their number will increase.

According to BustleIt is expected that the lawsuit filed on Friday by Public Citizen will be just one of many. On the same day, plans to sue Trump tweeted the American Civil Liberties Union (ACLU), challenging Trump’s “blatantly illegal national emergency declaration”.

“There is no state of emergency,” the message said. “This is an unconstitutional power grab that harms American communities.” We'll see him in court."

But the flood of lawsuits is unlikely to come as a surprise to Trump. In declaring a state of emergency on Friday, the president said he expected to be prosecuted and, moreover, expected lower courts to rule against him.

“We will win in the Supreme Court,” he said.

Wide discretion of the president can make it difficult to make court decisions that Trump has exceeded his authority, writes AOL. The courts often do not want to go beyond the excuses that the president used to declare a state of emergency, said Peter Shane, a law professor at Ohio State University.

But other legal experts said that the facts strongly opposed the president. This includes government statistics showing a long-term reduction in illegal border crossings, as well as Trump’s refusal of a deal that would provide more than 1,4 billion dollars for border security in the budget agreement signed on Thursday. Rep. Michigan Republican Justin Amash said that the Congress made a conscious choice not to give Trump what he wanted.
