Mikhail Efremov suddenly pleaded guilty to a fatal accident: the actor faces 11 years in prison

Prosecutor Diana Galiullina asks Efremov for 11 years in a general regime colony and a ban on driving a car for three years. In addition, they want to recover from the accused 500 thousand rubles (6,6 thousand dollars) to compensate for moral damage caused to the eldest son of the deceased driver Sergei Zakharov. The son filed a claim for 7,3 million rubles (96,7 thousand dollars) - the claim was partially satisfied.

The rest of Zakharov's relatives asked for a symbolic one ruble, the prosecutor also asked to satisfy this request, the BBC correspondent reports.

Admitted guilt

His lawyer Elman Pashayev announced Efremov’s desire to admit guilt even before the start of the hearing. After Judge Elena Abramova opened the trial, the actor stood up and said: “I have a statement... Your Honor, wait, I want to admit guilt: I admit guilt!”

An accident involving the actor occurred on June 8 on the Garden Ring in Moscow. Since then, he has made contradictory statements in this regard, as has his defense. At first, Efremov admitted his guilt, then retracted his words. In court, he called the edited video where he pleaded guilty.

The last version that the actor adhered to was that he might not have been driving, but was “pulled” into the jeep he owned. He doesn’t remember what exactly happened on June 8, Efremov stated in court.

After the defendant's plea of ​​guilt, the prosecutor began to speak at the debate. She stated that the actor's guilt was proven, and stressed that during the trial he refused to testify and did not want to admit his guilt.

According to "KP", according to the prosecutor, the decisive confession was expected to be heard from the actor earlier, so Efremov may not count on a less severe punishment.

Among the main arguments of the prosecution are the testimony of witnesses, video recordings made at the scene of the accident, and an examination, as a result of which traces of Efremov's DNA were found on the driver's airbag.

According to Galiullina: an aggravating circumstance - the actor was repeatedly brought to administrative responsibility; mitigating - the state of health of Efremov, the presence of two minor children and the provision of material assistance by the actor to the victims.

How the defense was built

In the course of the trial, Yefremov's defense declared his innocence.

The lawyers tried to present different versions to the court. According to one of them, the actor was not driving. There were even witnesses in court who said that they had seen Efremov in the passenger seat. But they could not find themselves in the video from the accident scene. In addition, their testimony contradicted what the witnesses from the side of the victims, relatives of the deceased driver Sergei Zakharov, said.

According to another line of Efremov's lawyers, the deceased Zakharov could have received fatal injuries not as a result of an accident, but because eyewitnesses overturned the driver's van after the accident. But this version was questioned by a forensic expert who spoke in court. According to her, the injuries that led to death, Zakharov received almost immediately as a result of the blow.

Efremov himself claimed that he did not remember anything about the events of June 8. The prosecutor described this position in the debate as “astonishing forgetfulness and selectivity,” because immediately after the accident, during the preliminary investigation, the actor admitted that he was driving.

The prosecutor also noted that Efremov initially repented to Zakharov’s family, but “changed his position” after lawyer Pashayev entered the case.

“My fault is drunkenness. But I don’t want to take all the blame for the October Revolution,” Efremov said in court at one of the previous hearings.

During the debate, the state prosecution must ask the court to impose a sentence on Efremov.

The actor was charged under paragraph “a” of Part 4 of Article 264 of the Criminal Code of the Russian Federation (violation of traffic rules resulting in the death of a person through negligence). The punishment ranges from 5 to 12 years in prison.

Efremov is now under house arrest.
