“This tactic of deceiving the court was successful, and Judge Oksana Parfeni ruled in favor of RadioStars without even stating the reason why she made such a decision, despite the clearly fabricated evidence presented by the plaintiff. Perhaps this could be seen as technical ignorance, if not for the fact that the subsequent attempt to appeal this decision was rejected by the court of second instance, the judges (Marina Anton, Vitalie Cotorobai and Ion Turcan), who motivated their refusal by the fact that Matvil's lawyers Corp. did not have the authority to represent Matvil, although earlier judge Oksana Parfeni, who considered this case in the first instance, did not express such doubts during the trial,” the company’s press service said in a statement.

The first suspicions that the judges were biased arose when the judge of first instance, Oksana Parfeni, rejected the request of the lawyer Matvil to invite technical experts to the court, who were ready to provide incontrovertible evidence of the falsification of the facts provided by the plaintiff and to include expert testimony into the case, the press service of the company said .

The second suspicious fact was the absence in the judge's verdict of the justification for her decision.

The third fact testifying to the absence of legality in the Moldovan court was that when the appeal was filed to the court of second instance, the decision to refuse the appeal was not even sent to the defense lawyers, who learned about the unauthorized decision only when this decision was already published publicly , thus intentionally depriving Matvil's lawyers of the opportunity to appeal this decision immediately to the court of second instance. What, in fact, was a blatant violation of elementary legal norms.

“This series of non-compliance with the requirements of the Law by the very system that is designed to protect it shows that it serves the interests of a certain group of people,” the company is convinced.

Using a corrupt Moldavian judicial system, unscrupulous competitors are trying to destabilize activities and cause serious financial and reputational damage to American and Canadian companies that do not and do not think of doing business in Moldova.
