LinkedIn will block in Russia

LinkedIn business social network will become unavailable in Russia on November 14-15. The legality of the blocking was recognized earlier by the Moscow City Court, which gave Roskomnadzor the right to take appropriate measures. This is still the first company in Russia, the issue of blocking with which was decided in court, but the department notes that in the future this mechanism can be used in relation to other organizations.

From what it all began

The conflict between Roskomnadzor and LinkedIn arose due to the violation by the company of the law on the storage of personal data of Russians.

The document entered into force on September 1 2015. In accordance with it, organizations must store relevant information exclusively on the territory of Russia. The requirement concerns both foreign firms and Russian ones.

If violations are discovered as a result of a routine or unscheduled inspection, Roskomnadzor must issue a prescription to the company, according to which it will have to eliminate these violations by up to 6 months. If this does not happen, she is charged a fine. However, there are other ways to force organizations to comply with legal requirements. For example, a violating company can sue both Roskomnadzor and an ordinary Russian citizen who has noticed the violation. The Office may block the resource only by a court decision. At the same time, after elimination of the violation, access to the site should be restored.

In late October, it became known that Roskomnadzor was forced to follow the path of litigation. LinkedIn was never able to explain how it fulfills the requirements of the legislation on the storage of personal data.

Lock is legal

10 November The Moscow City Court issued a decision 2016, which recognized LinkedIn blocking in Russia as legal. Thus, the LinkedIn appeal was rejected. The social network will be included in the registry of prohibited sites 14-15 November.

Representatives of the social network, arguing their disagreement with the claims of the supervisory agency, emphasize that the processing of user data outside the United States is handled by LinkedIn Ireland, and not LinkedIn Corporation, which is the defendant in Roskomnadzor’s lawsuit. The lawyer of the company in court stressed that the agency did not provide evidence that LinkedIn Corporation is responsible in this situation.

In addition, it was emphasized that the LinkedIn network does not operate in Russia and does not identify users based on their place of residence.

However, the representative of Roskomnadzor denied all the allegations concerning the question of the improper defendant, stressing that the claims are made to the administrator of the domain name, which is LinkedIn Corporation.

Later, LinkedIn reported their interest in meeting with Roskomnadzor to discuss the issue of data localization. However, on November 11, Ampelonsky stated that the company had not yet addressed the agency.

"Not the smartest thing to do"

Of course, the conflict of social networks and departments could not fail to attract the attention of the Internet ombudsman.

According to him, LinkedIn does not engage in any commercial activities and does not collect personal data from users as such. He also emphasized that this is not a very “good case” for Roskomnadzor.

According to the law on the storage of personal data of Russians, the social network will be excluded from the registry of prohibited sites after the elimination of violations.
