How to get a work permit in the US if you have an emergency

In order for an applicant to qualify for an EAD due to an emergency, the applicant must meet the following eligibility requirements:

• the main applicant is the primary beneficiary of an approved Form I-140 "Immigrant Petition for Foreign Workers" in the 1st, 2nd, or 3rd Employment-Based Priority Category

Place of Employment Priority categories refer to the system used by the US Immigrant Program to allocate immigrant visas. The main factor that determines the priority category is the type of work for which the I-140 petition is being filed.

First priority category (EB-1). It is intended for individuals with special skills or accomplishments, including scientists, educators, research workers, executives of large companies, or individuals with outstanding artistic ability.

The second priority category (EB-2) includes individuals with professional degrees, as well as individuals with exceptional ability in the sciences, arts, or business.

The third priority category (EB-3) is for professional workers, artisans and unskilled workers.

• the main applicant has a valid E-3, H-1B, H-1B1, O-1, or L-1 nonimmigrant status or an authorized grace period at the time of filing Form I-765, Application for Employment Authorization

E-3: The E-3 visa is a special visa for Australian citizens who wish to work in the United States. It is intended for individuals who have specialized knowledge or skills and wish to enter a job that requires such skills. Usually these are vacancies that provide for higher education or professional skills.

H-1BA: The H-1B visa is one of the most common visas for non-immigrants who want to work in the US. It enables foreigners with specialized knowledge and skills to work in a sponsored position in a US company. This visa is often used for professional professionals such as programmers, engineers, analysts, etc.

H-1B1A: The H-1B1 visa is a special visa for citizens of Chile or Singapore who wish to work in the United States. It is similar to the H-1B visa and provides an opportunity for foreigners with special professional knowledge or skills to take jobs that require such skills.

O 1A: The O-1 visa is a visa for individuals of extraordinary ability in the sciences, arts, education, sports, or business. This is a visa that allows highly qualified and talented individuals to obtain legal status to work in the United States.

L-1: The L-1 visa is an intra-corporate transfer visa and allows multinational companies to transfer their employees from abroad to divisions or subsidiaries in the United States. This allows companies to bring in their employees with specialized knowledge, as well as management personnel or employees with special functions from abroad to work in the US division.

• main applicant did not apply for change of status
• an immigrant visa is not available to the applicant in accordance with the priority date indicated in the U.S. Department of Foreign Affairs Visa Bulletin Expiration Date in effect at the time Form I-765 is filed

In this context, “priority date” means the date that determines when an applicant may apply for an immigrant visa. The U.S. Department of Foreign Affairs regularly publishes a visa bulletin that indicates which priority dates are allowed for various categories of immigrant visas. If the applicant's priority date has not yet arrived, he cannot obtain an immigrant visa.

• the applicant and his dependents will provide biometric data as needed
• the applicant and his dependents have not been convicted of a felony or two or more offenses
• USCIS determines, in its sole discretion, that the principal applicant demonstrates compelling circumstances justifying the issuance of a work permit

The guidance covers exigent circumstances for principal applicants as well as their dependents and contains a non-exhaustive list of situations that may lead to the conclusion of compelling circumstances, including serious illness and disability, compelling differences with an employer, and others.

The guide contains, among other things, details of the evidence that an applicant can provide in support of one of these compelling circumstances.

For example, a principal applicant with an approved immigrant visa application in an overcrowded visa category who has lived in the United States for a long time may provide evidence such as school or post-secondary enrollment documents, mortgage documents, or long-term lease documents to confirm that there are strong arguments in favor of the potential recognition of the presence of weighty circumstances.

Such circumstances may include the loss of a job, which may force a family to sell their home at a loss, withdraw their children from school, and relocate to their home country.
